My works are not to be used for NFT purposes, nor to be made into NFTs, or anything related to NFT/cryptocurrency. If I see this occur I //WILL// file a DMCA and take legal action against it.

My works are not to be used for AI training or machine learning in any way, shape, or form. This includes commissioned work, even with commercial usage rights. If I find that my work is being used or purchased for the sake of furthering Generative AI training I will revoke all rights to said work and seek legal action at my discretion.

I hold all rights to fair use with any pieces I produce. They may be posted, used as examples, and as portfolio pieces as needed.

You may use my work for personal use, given that credit is explicitly provided.

I will not replicate any other artist's style under any circumstances, including individual artists like myself AND art styles from well-known or famous IPs.

I have the right to decline commission and purchase inquiries without giving an explicit reason.

I use the block and mute buttons liberally on the platforms I am on, this is not a slight at any individual, I am just a very solitary person.

My art and designs may not be used for your own monetary platforms - ie Patreon, substar, etc - or for your gain whether this be advertisement or profit, without the purchase of full commercial use. Please see commercial use terms for more information on obtaining commercial rights.

I am okay with drawing characters from large media and other such IPs. Such commissioned work is for personal use only, and commercial rights can NEVER be purchased for such work.

Please remember that I am human and that I have other life commitments.

Clear and visual references MUST be provided. I will not take a written description of a character for a commission.

Updates and notice of any delays will be crossposted via my twitter and trello predominantly. I will also send individual notices to clients as needed, but please check the trello as it is updated most frequently.

I will send WIPs (work in progress) as necessary based on the type of commission purchased. I keep the amount of WIPs sent very limited as it slows my process down immensely and I am a very facetious and slow artist to begin with.

Major adjustments may be made during the sketch phase. I will only accept minor adjustments beyond the sketch phase. Excessive adjustments will incur a fee after the 5th change.

Adjustments due to client negligence, ie missing references or not telling me something explicitly, may incur a fee on a case-by-case basis. This predominantly applies to large adjustments.

I encourage redlines and draw-overs when it comes to asking for changes, please don’t be shy! I would much rather get your commission right than leave you unsatisfied with the piece.

A final check before completion will always be sent unless the client explicitly permits me to go forward without their approval process. This is to ensure nothing is missing before I complete the piece and move on.

I reserve the right to reject or question any critique/stylistic choice if I find it to affect the overall composition or feel of the piece - with said hesitation discussed as clearly as the client requires.

You will receive a full-resolution, unwatermarked (but signed) piece upon completion, as well as any variants or transparent versions requested.

Pieces may be posted online at half resolution or smaller unless explicitly requested otherwise.

Uncoloured sketches, unfinished commissions (ie a partial refund), and other such work of that nature may not be completed by the client or third parties without my permission. I don’t mind this at all, just ask first, please!

Commission prompts, slot types, etc, can be changed entirely at any time if requested - free of charge for unstarted slots so long as the work is of equal value as the slot purchased. If it is a slot with significant progress this may incur a fee depending on how old the slot is.

Multiple older/pending slots - if not started - may be consolidated into a larger project if the client so wishes and if this is something I’m willing to take on. Consolidation is discussed on a case-by-case basis!!

I reserve the right to cancel a commission (at any stage of progress) if the client is rude, has poor communication, or breaches these terms of service. A partial or full refund - depending on how much progress was made - will be provided once available.

I do NOT accept any form of cryptocurrency as payment.

All payments will be made via goods & services only, I do not accept friends & family EVER as payment.

A commissioned piece is considered ‘digital goods’ and will not be shipped to an address.

Commissioned pieces must be paid in full and upfront before work is begun unless otherwise stated.

Payment plans are only available for trusted clients, completed files will not be provided until payment is fully completed. Commission work will not be started until half of the payment has been made.

Payment will be done through means of paypal.me links or via invoice if requested.

Full refunds are available - if explicitly requested - for pieces that are not yet started or very early within the sketch phase.

NO REFUNDS on in-stream commissions, same-day commitments, or on work that is nearly completed.

Partial refunds are available for work that is within the lineart phase or halfway done only if explicitly requested by the client. Anything past the halfway point cannot be refunded.

I reserve the right to issue refunds for commissions that are unstarted or up to halfway done of my own volition. Commissions that I decide to refund will not be continued, nor will I have any interest in continuing the slot. I also reserve the right to give no reason for doing so.

PLEASE BE AWARE that refunds can and will most likely take me a while to provide due to my current financial situation. I will be upfront with the client on my timeframe for providing said refund.

All designs created by me must be credited to me, regardless of commercial use rights.

Adopts and custom design work automatically come with personal use, aka limited rights, upon purchase. Please see Commercial Usage Terms for more information.

Designs and characters may be resold, retraded, or gifted based upon the following terms.

Please inform me first before resale/trade/gifting of a design! This is to reduce the risk of a design being lost to the void and also to ensure the design is not being sold to anybody blacklisted by me.

You may edit a design by me, and designs by me may be edited by third parties except in the case of blacklisted individuals. Permission is not needed but is appreciated. I can provide a PSD or CSP file for the design if you wish.

Traded designs may only be retraded, if you wish to sell a design of mine obtained in a trade you may only sell it for any USD value you put into it.

Gifted designs may only be regifted. Gifted designs lose all USD and trade value.

If for whatever reason a blacklisted individual acquires a design of mine, or if a design owner breaks these terms, I reserve the rights to reclaim the lineart of said design for my personal use.

These policies do not apply to COLLABORATIVE adopts and design work. Any collaborative designs will receive a custom policy based on my own and my collaborative partner’s needs.

Some adopts may come with additional terms and clauses, in which case both this T.O.S and the additional T.O.S will apply. The buyer will be given the additional terms to read and agree to before purchase.

Gifting, trading to, selling to, or purchasing for anybody on my blacklist will result in being blacklisted and blocked as well.

I offer commercial use as an option on all inquiries and design purchases, pricing is explicitly discussed with the client upon request.

General commercial use starts at a fee of 100% of the price - but may be higher depending on the client's use of the art, custom, or adoptable design. This can be discussed in detail with the client before moving forward with a project or purchase.

Commercial use on a project or design DOES NOT MEAN that my work can go uncredited, all work produced by me must be credited to me.

I reserve the right to use any commercial work for examples of my work and portfolio purposes.

Personal use, aka limited rights, is defined as follows. You may repost the work, upload it to Toyhouse or other such character-based websites, use it for personal projects, and use the work as banners or icons for profiles, so long as nothing is being used for commercial gain - and credit MUST be provided when my work is used. In essence, use it however you like so long as I am credited, it is not for profit or commercial gain, and so long as it is following the aforementioned terms above.

Commercial use, aka full rights, is defined as follows. You may use the work for advertising your monetary platforms, you may use it for assets in commercial projects, as well as any terms discussed on a case-by-case basis with the client. You may use the work in the same manner as most personal use cases as well. You must credit me for my work whenever or wherever it is used, a watermark with my username will suffice!
